Foreign individuals or entities are permitted to acquire a property interests within Mexico through a Trust Deed agreement (fideicomiso) executed before a notary public with a Mexican bank as the trustee. These trusts are very similar to those used for estate planning purposes in the USA and Canada . The bank holds the property in trust for the foreigner and acts upon his/her instructions. The foreigner retains the exclusive right to use or control the property and may sell, will, lease or rent the property freely. Trusts are granted for up to 50 years and renewable for additional terms. Upon selling the property or winding up the trust, all proceed from sale or disposition go to the foreigner or his/her beneficiaries.
